I. INTRODUCTION

  1. The portal www.gscore.eu (hereinafter referred to as the gScore portal“ or the “Portal“) is provided and administered by the company M square s.r.o., company registration No. 291 92 285 with registered office at Příkop 843/4, Zábrdovice, Brno, ZIP 602 00, enrolled in Commercial Register at the Regional Court in Brno, section C, inlet No. 64517.

The services provided by the gScore portal primarily consist of collection, administration, processing, storing and searching for data of individual users in order to keep them informed about their sporting activities and achievements; the Portal also enables and provides access to tournament registration and facilitates tournament organisation while the users may become members of sports associations and more.
  4. gScore portal terms and conditions of use (hereinafter referred to as the “Terms and Conditions“) are effective and binding for all users of the gScore portal. The Terms and Conditions also apply to the mobile version of the gScore portal.
  5. By registration with the gScore portal, the user confirms getting acquainted with the Terms and Conditions. The user agrees to follow the conditions of use. The Terms and Conditions apply proportionately to the non-registered users.
  6. If the user does not agree with the Terms and Conditions, they are not granted permission to use the content of the gScore portal. 

II. GSCORE PORTAL PURPOSE

  1. The purpose of the gScore portal is to help course owners, tournament organisers, sports associations, sports clubs and players to better, faster and more efficient work and entertainment at various sports courses.
  2. Via the gScore portal, a registered user is provided with the option of gaining membership in various sports associations or clubs - both at one member card; they may register on-line for matches and tournaments, book courses and apply for discount at partners of the portal and individual courses. Within the user profile, all results from tournaments and individual matches are stored.
  3. The user provides their personal data for the purpose of enjoying the benefits of a registered user; the data is processed by the provider and it is accessible by the partners of the provider in order to provide the full scope of the gScore portal services.

III. GSCORE PORTAL USE

  1. The access and use of the gScore portal is free of charge.
  2. The user has the option of registration at the gScore portal. The registered users are entitled to extended scope of services (i.e. storing all results from tournaments and individual matches, discounts on individual courses and discounts provided by the gScore portal partners, simple tournament registration, on-line course reservation etc.). The non-registered users do not have full access to all functionalities and services provided by the gScore portal.
  3. The gScore portal registration is voluntary. The registration may be cancelled at any time.
  4. The user registration is facilitated by filling registration form which is to be found on the gScore portal. Within the process of registration, the user is required to provide agreement with the Terms and Conditions, otherwise the user registration is not possible.
  5. During the registration process, the user is required by the gScore portal provider to give identifying information (the first and last names, date of birth, e-mail etc.) and further information the user submits voluntarily. The user takes into consideration that some of the entities that use the gScore portal (association, clubs, course owners and administrators etc.) and partners of the provider require, for the purpose of the services offered, detailed identifying and other data. The user may add such detailed identifying and other information (if required and in the case the user is interested in the services by the entities using the gScore portal) at any time given their profile is active.
  6. The user shall give true and complete identifying and other information in their user profile. In the case a user gives false information, the provider is entitled to cancel the user’s registration or to restrict the supply of services. Under no circumstances shall the provider be held liable for damage which may be caused by cancelling the user’s registration or by restriction of the supply of services.
  7. Each user shall use only one user profile.
  8. By registration, the user gives their consent to the processing of personal data they provided for registration or which they give while using the services of the gScore portal for the purpose of the supply of services. The provider is entitled to process user personal data for the entire duration of the supply of services.
  9. In the case the user gives consent to receiving newsletter, the provider is entitled to send the user messages about innovations, gScore portal news, promotion messages of the provider and their business partners or other entities. The user consent to receive newsletter is considered inclusive of consent to receiving advertisements. The user can unsubscribe from the newsletter / commercial communication list at any time.

IV. MEMBERSHIP IN COURSES/CLUBS/ASSOCIATIONS, PARTICIPATION ON SPORTS EVENTS

  1. In case a user registers through gScore portal as a member of some associated courses/clubs/associations, the contractual relationship originates between the user and the given course/club/association exclusively. The gScore portal operator stands only as the negotiating party in between.
  2. Membership fee is in some cases possible to pay to the course/club/association through gScore portal payment gateway.
  3. The operator declares that a membership fee is not refunded to the user in case the individual course/club/association do not make it subject to different rules. In such cases the user applies for the membership fee refund exclusively at the particular course/club/association.
  4. A user is entitled to register through gScore portal for administered sports events. Registration fee for the given sports event is in some cases possible to pay to the event organiser through gScore portal payment gateway. The fee amounts are listed at the particular event and the pricing is fully in competence of the event organiser.
  5. The organiser and the entity responsible for the contents, settings and realisation of a sports event shall always be the particular organiser/course/club/association. gScore portal stands only as the negotiating party in between.
  6. Cancellation policy concerning registration fees paid for any sports event is set by each club/association individually. In case an organiser/course/club/association have not published their cancellation policy, the cancellation policy of sports event registration is subject to the gScore portal conditions as follows:
    In case a user cancels their registration for sports event organised by an organiser/course/club/association, gScore refunds 100% of the amount paid for the registration but only in case that the user cancels their registration before termination of the online registration for the event through gScore portal and, in addition, under condition the registration fee was paid through gScore payment gateway.

V. GSCORE PORTAL PROVIDER RIGHTS AND OBLIGATIONS

  1. The provider may process the user personal data in order to accomplish the purpose of the gScore portal.
  2. The provider makes no representations or warranties as to the continuous functioning of the Portal and shall not be held liable for any damage caused by the Portal non-functioning.
  3. The provider shall not be held liable for any damages of any kind arising from the use of the gScore portal.
  4. The provider is entitled to cancel the user’s registration or to restrict the supply of services in the case of breaching the Terms and Conditions or in the case of inappropriate use or abuse of the gScore portal. The provider is entitled to cancel the user’s registration also in the case of the Portal change or dissolution.
  5. The provider is entitled to interrupt the operation of the portal for the purpose of maintenance without prior notice.

VI. USER RIGHTS AND OBLIGATIONS

  1. The user shall comply with the Terms and Conditions and with the provisions of law in force.
  2. The user shall not, in particular:
    • Use vulgarisms, words, combinations of words or signs contrary to the provisions of law in force or to the generally accepted ethical and moral principles;
    • Use threats and similar attacks against other Portal users, partners or other interested parties within the gScore portal;
    • Give false, offending, misleading or other inappropriate information about other Portal users, partners or other interested parties within the gScore portal;
    • Promote violence, stir up hatred;
    • Take other inappropriate, unethical or unlawful actions.
  3. The user is responsible for their contributions and the information presented in their profile.
  4. The user shall comply with other provisions of the Terms and Conditions.

VII. PERSONAL DATA PROTECTION

  1. Personal data of the users who fill in the registration form are processed by the gScore portal operator along with laws in force, in particular with the General Data Protection Regulation..

VIII. COPYRIGHT PROTECTION

  1. The provider is the sole owner and administrator of the Portal www.gscore.eu and other subdomains. The copyright is exercised by the provider.
  2. The gScore portal is an original work under Law No. 121/2000, Copyright Act, as amended.
  3. Without the prior written consent of the provider, the users are not entitled in relation to the gScore portal contents to use, copy, spread the text, images or audio files or in any other unauthorised way interfere in the copyright of the provider.
  4. The provider shall not be held liable for any information, data and other contents supplied, published or stored by the users on the gScore portal.

IX. FINAL PROVISIONS

  1. The provider reserves the right to unilaterally alter the Terms and Conditions without restrictions; the users will be informed of the actual wording by its publishing on the gScore portal.
  2. The user shall keep themselves informed of the changes in the gScore portal Terms and Conditions of use. In the case the user is registered and uses the gScore portal, it is recognised that they agree with the alterations in the Terms and Conditions without reservations.
  3. The relations between the user and the provider in connection with use of the gScore portal are governed by the Terms and Conditions and the provisions of law in force.
  4. The Terms and Conditions enter into force on 1st January 2014.
